Probation Violations: Penal Code 1203.2

• Missing a court date, a probation appointment, or a class.
• A new arrest or charge.
• A failed or missed drug test.
• Contact that violates a protective order.

• Reinstate probation on the same terms, or modify the terms.
• Revoke probation and impose a sentence, up to the maximum for the original offense if sentence was suspended.
• Under PC 1203.2(a), probation cannot be revoked only for failing to pay fines, fees, or restitution, unless the court finds you willfully failed to pay when you were able to.

• Arrange to address a warrant before you are picked up.
• Show compliance: proof of classes, work, treatment, or payments.
• Challenge the allegation at a probation violation hearing.
